主讲人简介:Robin Warner,澳大利亚卧龙岗大学法学院副教授,悉尼大学法学博士,曾供职于澳大利亚皇家海军法律部、司法部、联合国海洋法会议代表团等,现供职于澳大利亚国家海洋�源及安全中心、世界自然保护联盟环境委员会、海洋和南极研究所科学顾问委员会、塔斯马尼亚大学等多个专业机构。其研究领域包括海洋法、海洋环境法、气候法与政策、海洋安全与国际刑法。Warner教授的研究致力于促进海洋多元化应用中的平衡与可持续发展,其研究成果得到了国际社会的广泛认同。

 

 

Marine protected areas (MPAs) and area based management tools such as marine spatial planning are at the leading edge of global efforts to secure more effective conservation and management of the marine environment. The value of and commitment to MPAs have been endorsed in a wide range of global and regional fora over the past decades including the UNGA, Rio+20, BBNJ Process, the World Conservation Congress and the World Parks Congress. This presentation will examine the international law foundation for MPAs in marine areas beyond national jurisdiction (ABNJ). It will then analyse some of regional examples of MPAs in ABNJ and the legal and policy challenges involved in establishing these MPAs. These will include the North East Atlantic, the Mediterranean, Antarctic waters and the Sargasso Sea. The presentation concludes that targets and deadlines can be a positive impetus for progress eg., the CBD Aichi Targets and the Rio+20 target for a decision on an negotiation process for a possible new instrument under UNCLOS. Also cross sectoral and cross institutional connections are vital to marine ecosystem protection and beneficial for many reasons including trust building, balancing of conservation and sustainable use objectives and sharing of monitoring, surveillance and enforcement responsibilities.
