On March 30, 2019, seminar on “The Basic Areas of Rule of Law and Regulation” sponsored by the Government Regulation Professional Committee of China Administrative Law Society, Guanghua Law School of Zhejiang University, and The Public Law and Comparative Law Institute of Zhejiang University was held successfully in Hangzhou. Prof. Zheng Chunyan, Vice Dean of Guanghua Law School warmly welcomed them all the scholars who accepted the invitation to this meeting.
Ms. Zheng Chunyan, deputy dean of Guanghua law school, Zhejiang University, and Mr. Li Honglei, director of the research office of constitutional and administrative law, institute of law, Chinese academy of social sciences, welcomed and thanked all the scholars participating to this meeting. Ms Zheng hoped that this conference could strengthen the discussion on regulation and promote the transformation of administrative law and the expansion of new fields In addition Mr. Li Honglei especially l highly appreciated the work done by Law School.
The first section of the seminar was centered on “Basic Principles of Regulation and Rule of Law” Firstly Prof. Zhang Qing, from the Institute of Law and Economics of China University of Political Science and Law, gave a report entitled "Legal and Economic Analysis of Joint Disciplinary Mechanism of Untrustworthiness". In addition, Dr. An Yongkang delivered a speech on "Legality and Legitimacy: The Combination of Administrative Law and Government Regulations". Moreover, Dr. Jin Jian from the Law School of University of Göttingen gave a report of “The Evolution of Administrative Law: Based on Social Self-Regulation restricted by (Government) Regulations”.
The second section focused on “Risk Regulation” and was chaired by Prof. Zhu Mang. Firstly, Prof. Jin Zining gave a presentation on "Judicial Review of Scientific and Technological Professional Administrative Decisions: Taking EIA Approving Litigation as an Example". Furthermore, Associate Prof. Song Yahui delivered a speech on "Thoughts of Risk Regulation and Its Transcendence". During this section Scholars was also invited to discuss share their ideas about the issues related to the topic.
Finally the theme of the third section was “Regulation Strategy”. First of all, Mr. Tan Binglin gave a presentation on "The Analysis on Management-Based Regulation". Additionally, Ms. Li Qin from Law School of Hebei University stated her idea about goal and path of enterprise legal regulation. In the section, there was also a free discussion between the scholars altogether on the topic.
Thus, Prof. Zhang Jiansheng put forward three thoughts on the basic categories of the rule of law and regulation: regulation could be explained in two aspects, regulation was closely related to administrative law, and the opinions upon regulation were separated into two sides. And Prof. Song Hualin gave a conclusion from different aspects.
In conclusion, the seminar had allowed scholars to exchange their ideas about rule of law and regulation, and promote the development and reform of China's administrative law theory
